Creator Terms of Use
1. Who we are and scope of these Terms
UNVRS is operated by UNVRS AGENCY, a French société par actions simplifiée (SAS), with registered office at 47 rue Vivienne, 75002 Paris, France, SIRET 105 935 589 00017 ("UNVRS", "we", "us" or "our").
These Terms govern access to and use of the UNVRS platform, website and services by creators, studios, agencies, educators, creative businesses and other professional or aspiring professional users. Certain features may also be used by brands, institutions, schools, museums, galleries, retailers and other organisations. Additional feature-specific terms may apply where clearly presented before a transaction or project is accepted.
If feature-specific terms conflict with these Terms, the feature-specific terms prevail only for the relevant feature, project or transaction and only to the extent of the conflict. No feature-specific term may retroactively remove rights in creative work already uploaded or submitted.
2. Definitions
User: any person or organisation using UNVRS.
Creator: a creative professional or aspiring professional, including a designer, artist, filmmaker, photographer, architect, musician, writer, craftsperson, content creator, freelancer, educator or similar user.
Studio: a studio, agency, collective, production company or other creative organisation.
User Content: any work, portfolio item, artwork, design, image, video, audio, text, project file, brief, resource, comment, message, profile information or other material submitted to UNVRS.
Project Content: User Content shared within a project, collaboration, private Moodspace, meeting, brief or other restricted workspace.
Platform Analysis: service-generated descriptions, tags, embeddings, structured metadata, recommendations, compatibility signals, Portfolio Intelligence outputs, Network Intelligence outputs and similar service data.
General-purpose model: a machine-learning or generative AI model intended for broad use across many tasks or customers, rather than solely to provide a specific UNVRS function to the requesting User.
3. Eligibility, accounts and professional identity
Users must provide accurate account information and must not impersonate another person or organisation. Professional users should identify the business, studio or professional capacity in which they act where relevant to a transaction.
Users must be at least 18 years old to contract directly with UNVRS, unless access is provided through an authorised school, institution or guardian arrangement that validly permits participation under applicable law.
UNVRS may request reasonable verification where necessary to prevent fraud, protect users, comply with law or verify eligibility for a specific professional opportunity.
4. Plans, pricing, renewals and cancellation
UNVRS offers a free creator plan. Paid creator plans are optional and are not a condition for maintaining a creator profile, being discoverable for relevant opportunities or participating in the core UNVRS ecosystem, subject to the functionality included in each plan.
Current creator prices are listed in Schedule A. Paid subscriptions renew according to the billing period selected at checkout until cancelled. Users may cancel renewal at any time from the subscription controls made available by UNVRS. Cancellation takes effect at the end of the current paid period unless applicable law requires otherwise.
Any future price increase will be communicated before it takes effect. Mandatory consumer rights, including any applicable withdrawal rights for distance contracts, remain unaffected.
5. No exclusivity and no automatic project commission
UNVRS does not require creators or studios to work exclusively through UNVRS. Users remain free to use other platforms, agencies, galleries, representatives, marketplaces, client networks and direct commercial channels.
UNVRS does not charge an automatic commission on a project, commission, employment engagement, licence, exhibition, retail relationship or other professional collaboration solely because the parties discovered one another through UNVRS.
A platform commission applies only where a User voluntarily chooses a monetisation feature for which a fee is disclosed in advance, including Marketplace sales and paid Masterclasses as described in Schedule A. Any new transaction fee must be disclosed before the User commits to the transaction.
6. Ownership of creative work
Creators and other rights holders retain all intellectual-property rights they lawfully hold in their User Content. Uploading, displaying, analysing or sharing User Content through UNVRS does not assign or transfer ownership of that User Content to UNVRS.
Nothing in these Terms is intended to waive or transfer an author's moral rights where such rights cannot be waived or transferred under applicable law.
A public profile, portfolio preview, match card or recommendation does not grant other Users a licence to reproduce, adapt, commercialise, train on, resell or otherwise exploit the underlying creative work.
7. Limited technical licence granted to UNVRS
To operate the service, the User grants UNVRS a non-exclusive, royalty-free, limited and revocable licence to host, store, reproduce for technical purposes, format, display, transmit and process User Content solely as necessary to provide the services selected by the User.
This licence is worldwide only because UNVRS may be accessed internationally. It does not permit UNVRS to sell the User Content as a dataset, independently commercialise the creative work, create unrelated commercial derivative works, or license the creative work to third parties for their own purposes.
UNVRS may permit technical service providers to process User Content only to the extent reasonably necessary to provide the relevant UNVRS service and subject to contractual protections consistent with these Terms.
The licence ends when the relevant User Content is deleted or the account is closed, subject to limited backup retention, legal obligations, dispute preservation and content that another User is independently entitled to retain under a specific project agreement.
8. Public, private and project content
Users control which content they choose to publish as part of their public or discoverable profile, subject to the controls available for the relevant feature. Public content may be shown within UNVRS search, recommendations, profile cards and project matching where this is part of the User's selected discovery settings.
Project Content shared in a restricted project, collaboration or private workspace is not public portfolio content. UNVRS will restrict access according to the workspace permissions and service functionality.
UNVRS will not use a creator's portfolio artwork in paid advertising, press campaigns, external case studies or unrelated promotional materials without separate permission from the creator or rights holder, except for minimal factual references that do not reproduce protected creative work where legally permitted.
Where UNVRS offers external search-engine indexing controls, the User's selected setting will govern whether eligible public profile content may be indexed.
9. Portfolio Intelligence, Felicity and AI-assisted features
UNVRS may offer AI-assisted or algorithmic features including Portfolio Intelligence, Creative Identity, Creative Compatibility Score, Network Intelligence, recommendations, Felicity, meeting summaries, search assistance and project reasoning.
These features may analyse User Content and account context to generate descriptions, tags, structured signals, recommendations and other Platform Analysis. Processing may include temporary technical copies, embeddings or machine-readable representations needed to provide the requested function.
Platform Analysis is intended to assist discovery and professional decision-making. It is not an authoritative judgement of artistic quality, professional worth, talent, employability or legal rights.
Users remain responsible for final decisions. UNVRS does not make solely automated decisions that are intended to produce legal effects or similarly significant effects on a User without appropriate safeguards required by applicable law.
Where a User identifies a factual error in profile information or Platform Analysis, UNVRS will provide a reasonable mechanism to request correction, removal or review, subject to technical and legal limits.
10. No model training without separate explicit opt-in
Core AI commitment Using Portfolio Intelligence, matching, Felicity or another AI-assisted UNVRS feature is not consent to train a general-purpose model on your creative work.
UNVRS will not use raw User Content to train, fine-tune or improve a general-purpose generative AI model, whether operated by UNVRS or a third party, unless the User has separately and explicitly opted in to that specific training use.
Any such opt-in must be separate from acceptance of these Terms, must identify the relevant purpose in understandable language, and must not be required merely to maintain a core UNVRS account.
Where a User has not opted in, UNVRS will require AI or infrastructure providers used for inference or processing not to use that User Content for the provider's own general model training, except where a different use is separately disclosed and lawfully accepted by the User.
A User who has opted in may withdraw that permission for future training use. Withdrawal will stop future inclusion of the User's content in new training datasets controlled by UNVRS. Technical limitations may prevent retroactive removal of influence from a model already lawfully trained before withdrawal, and any such limitation will be explained if relevant.
UNVRS may use aggregated or genuinely de-identified service telemetry to understand reliability, safety and product performance, provided it is not used as a substitute for the separate consent required by this section for training on identifiable or raw creative User Content.
11. Discovery, matching, ranking and Creative Compatibility Score
UNVRS is designed to surface creators, studios, teams, resources and opportunities based on contextual relevance rather than job title alone. The main parameters used in matching and ranking are summarised in Schedule B.
Recommendations may consider project requirements, disciplines, skills, portfolio characteristics, declared preferences, experience, availability, location, budget, rights, collaboration history, network context and other relevant signals. No single parameter guarantees placement or selection.
A paid creator subscription is not, by itself, a hidden factor in Creative Compatibility Score. If UNVRS introduces sponsored placements or paid promotional visibility, those placements will be clearly labelled and their effect on ranking will be disclosed.
Brands, institutions, studios and project owners always retain the final decision regarding whom to contact, shortlist, invite or hire. Creators likewise retain the decision whether to accept, decline or negotiate an opportunity.
12. Network Intelligence and Creative Graph
Network Intelligence may help a User understand existing professional relationships, complementary capabilities and relevant connections before expanding discovery to new people.
Creative Graph may retain project, role, collaboration and relationship context so that future recommendations can use prior professional context. Private relationship or project information will not be made public solely because it exists in the Creative Graph.
Users may request correction of materially inaccurate factual attributions concerning their own profile or participation. UNVRS may retain limited records where necessary for fraud prevention, legal compliance, transaction history or dispute resolution.
13. Projects, collaborations and commercial relationships
UNVRS may provide project briefs, team formation, messaging, meetings, calls, file sharing, planning, deliverables, approval, replacement recommendations, budgeting and collaboration tools.
Unless UNVRS expressly states otherwise for a specific service, UNVRS is not the employer, client, talent agent, legal representative or contracting party to the professional relationship formed between Users. The participating Users are responsible for agreeing scope, fees, payment timing, deliverables, usage rights, credits, licences, confidentiality and other commercial terms.
Project briefs, unpublished brand materials and files shared in a restricted collaboration may be used by participants only for the purpose of evaluating or carrying out that project, unless the owner authorises broader use. Users must respect any additional NDA or project-specific confidentiality terms.
If a collaborator declines or becomes unavailable, replacement recommendations do not transfer the original collaborator's rights or obligations to another person. Any replacement must be separately accepted by the relevant parties.
14. Brand Battles and creative challenges
Participation in a Brand Battle or creative challenge does not, by itself, transfer ownership of an entry to UNVRS, the organising brand or any third party.
Before submission, each challenge must state the material commercial terms that are specific to the challenge, including any prize or compensation, eligibility, judging process, required deliverables, intended usage, licence or assignment requested from a selected entry, relevant territories and duration where applicable.
Non-selected entries remain the property of their rights holders and may not be used commercially by the organiser without a separate agreement or other valid legal basis.
Where a selected entry is subject to a licence or assignment, those rights arise only to the extent clearly stated in the challenge-specific terms accepted by the participant and, where applicable, after the agreed compensation or conditions have been satisfied.
15. Marketplace and Creative Resources
Creators may choose to offer templates, files, assets, tools, resources or other digital goods through the Marketplace. The seller retains ownership of the underlying intellectual property except to the extent the seller expressly grants rights under the licence attached to the listing.
A Marketplace purchase gives the buyer only the rights stated in the applicable listing licence. Unless the listing expressly says otherwise, purchasing a resource does not grant the buyer ownership of copyright, the right to resell the resource as a stand-alone asset, or the right to use it to train or fine-tune an AI model or build a dataset.
UNVRS charges the Marketplace commission stated in Schedule A on qualifying sales. Any taxes, payment-processing costs or additional charges must be disclosed before the seller confirms the transaction where legally required or technically applicable.
16. Masterclasses and learning content
Creators may choose to publish paid or free Masterclasses and educational content. The teacher or rights holder retains the intellectual property in the Masterclass content.
Learners receive the access rights stated at purchase. Unless expressly stated otherwise, access is personal, non-transferable and does not permit redistribution, commercial republication, dataset creation or AI training using the Masterclass materials.
UNVRS charges the commission stated in Schedule A on qualifying paid Masterclass transactions.
17. Live Creation, Moodspace and collaborative tools
Live Creation may allow Users to stream, collaborate or create in real time. A User must have the rights needed to stream or share the material they provide. Recording or reuse of another participant's contribution must respect the permissions displayed for the session and applicable law.
Moodspace and similar collaborative canvases may contain public, shared or private material. Each contributor retains rights in the material they upload. Access to a Moodspace does not grant broader intellectual-property rights than those necessary to participate in the workspace.
Users must not copy private project material out of a collaboration space for unrelated use without authorisation.
18. Pricing Intelligence, rates and estimates
UNVRS may provide indicative rate, budget, production or pricing information. These tools are estimates and decision-support features only. They do not fix the price a creator must charge or the amount a client must pay.
Users remain free to negotiate their own commercial terms, taking into account rights, scope, exclusivity, production complexity, location, deadlines, experience and other relevant factors.
19. Reputation, feedback and professional history
UNVRS may display reputation or professional history signals based on platform activity, completed collaborations, verified participation, repeat work, feedback and other relevant context.
Users must provide feedback honestly and must not manipulate reputation systems through fake transactions, coordinated ratings, impersonation or other deceptive behaviour.
Where a materially inaccurate reputation event is attributed to a User, the User may request review through the available support or appeal process.
20. Intellectual-property protection against other users
Users may view content made available to them through UNVRS only for the purposes reasonably connected to the service, including professional discovery, project evaluation, collaboration, purchase or learning.
Without the rights holder's permission, Users must not:
scrape, crawl, bulk-download or systematically collect creator portfolios or project files;
create or contribute the content to a training dataset for machine learning or generative AI;
fine-tune, train or benchmark a model on another User's creative work;
use automated tools to reproduce a creator's portfolio at scale or create an unauthorised style-cloning dataset;
remove rights-management information, watermarks or attribution metadata;
resell, republish or commercially exploit another User's work outside the rights granted for the relevant project or purchase.
UNVRS may use reasonable technical and contractual measures to discourage automated scraping and misuse. No online platform can guarantee that a determined third party will never circumvent technical protections, and Users should not treat publication as a substitute for their own intellectual-property protection strategy.
21. User responsibilities and prohibited conduct
Users must have the rights needed to upload or share their User Content and must respect applicable law, third-party rights and project confidentiality.
Users must not use UNVRS to distribute unlawful, infringing, fraudulent, malicious or deceptive content;
harass others; manipulate matching or reputation systems; introduce malware; misuse personal data;
impersonate another person; or interfere with platform security.
Where User Content includes third-party intellectual property, confidential material, model releases, location releases or other rights, the User is responsible for ensuring that the intended use on UNVRS is permitted.
22. Content moderation, restriction, suspension and appeals
UNVRS may restrict, remove or disable access to content or accounts where reasonably necessary to enforce these Terms, comply with law, respond to a valid rights complaint, protect users, prevent fraud or cybersecurity harm, or maintain service integrity.
Where practicable and legally permitted, UNVRS will provide the affected User with a reason for a material restriction or suspension and a way to request review. Serious or urgent risks may require immediate action before notice.
For professional Users, where applicable law requires advance notice for termination of the entire intermediation relationship, UNVRS will provide the required notice and statement of reasons unless a lawful exception applies, including urgent legal, fraud, cybersecurity or repeated-breach circumstances.
23. Payments, taxes and third-party payment providers
Where payments are processed through UNVRS, the payment flow may be provided by a third-party payment provider identified at checkout. That provider's terms may also apply to payment processing.
Users are responsible for taxes, invoicing obligations, social contributions and other legal or accounting obligations arising from their professional activity, except taxes that UNVRS is legally required to collect or remit itself.
UNVRS will not introduce an undisclosed transaction fee. Fees applicable to a transaction must be shown or incorporated by reference before the User commits to that transaction.
24. Data protection, privacy and user controls
UNVRS processes personal data in accordance with applicable data-protection law, including the GDPR where applicable. Detailed information on data categories, legal bases, recipients, transfers, retention periods and data-subject rights will be provided in the UNVRS Privacy Policy.
The Privacy Policy is separate from these Terms and will explain how Users may exercise rights such as access, rectification, erasure, restriction, objection and portability where applicable.
AI-assisted processing that involves personal data will be subject to the same transparency and data- protection principles. Acceptance of these Terms is not a blanket consent for unrelated AI model training.
25. Account closure, deletion and post-termination data
Users may close their account subject to outstanding transactions, legal obligations and feature-specific commitments already accepted.
When an account is closed, UNVRS will stop displaying the User's public profile and will delete or de- identify content that no longer needs to be retained, subject to reasonable backup cycles, legal retention duties, fraud prevention, transaction records, dispute preservation and the rights of other Users under existing project agreements.
Where technically and legally feasible, Users may request an export of core profile information and their own project or transaction data before account closure. Internal security logs, proprietary ranking logic and data belonging to other Users are excluded.
26. Service availability, changes and new features
UNVRS is an evolving service. Features may be introduced, improved, renamed, combined or discontinued. UNVRS will avoid changes that silently strip Users of previously granted ownership rights or impose retroactive commercial terms.
New experimental or early-access features may have specific terms or limitations shown before use.
Participation in such a feature is optional unless it forms part of a User's selected plan and the change is made in accordance with these Terms and applicable law.
27. Disclaimers and limitation of liability
UNVRS does not guarantee that a User will receive a project, sale, commission, exhibition, employment opportunity, collaboration, audience growth or particular ranking. Matching and recommendation tools are contextual aids and can be incomplete or wrong.
UNVRS is not responsible for the independent professional performance, solvency, conduct or contractual compliance of another User merely because the parties met through UNVRS.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, intentional misconduct, gross negligence where applicable, or mandatory consumer and data-protection rights. Any limitation of liability will be interpreted only to the extent permitted by applicable law.
28. Changes to these Terms
UNVRS may update these Terms to reflect legal, security, product or commercial changes. Material changes will be communicated in a durable or otherwise appropriate form before they take effect where required by law.
For business users within the scope of applicable EU platform-to-business rules, UNVRS will provide at least 15 days' notice of proposed material changes, and longer where a change reasonably requires significant technical or commercial adaptation, unless a lawful exception permits a shorter period.
UNVRS will not apply retroactive changes that remove rights or impose new burdens on completed transactions except where required by law or where the change benefits the User.
29. Governing law and disputes
These Terms are governed by French law, subject to any mandatory rights that apply to a User under the law of their country of residence or establishment.
Before commencing formal proceedings, Users are encouraged to contact UNVRS so that the parties can attempt to resolve the issue in good faith. Any mandatory consumer mediation or redress rights remain available where applicable.
For disputes between UNVRS and professional Users, the competent courts will be determined in accordance with applicable law. Nothing in this section removes a mandatory jurisdiction or venue right that cannot lawfully be waived.
